Operator agreement

CroatianBoats is a marketplace and intermediary. Operators remain fully responsible for their boats, legal eligibility to rent, required licences, registrations and insurance, rental terms, skipper arrangements and delivery of the rental service.

Listing is free. CroatianBoats does not collect or deduct any part of your rental price or deposit. The platform charges the traveller a separate CroatianBoats Booking Fee, and its treatment follows the CroatianBoats refund policy and these terms.

Operators must keep listing information and availability accurate, including bookings taken outside the marketplace, must honour accepted and Instant Book bookings, and must not attempt to move contact or payment off-platform before a booking connection is complete.

Verification status shown on the platform reflects CroatianBoats' own review only. It is not a government verification.

You must honour confirmed availability and confirmed bookings. You remain responsible for the rental service and for all rental funds you receive directly, including the rental price, deposits, fuel, skipper charges and extras.

If you cancel a confirmed booking, CroatianBoats may provide the affected traveller with a CroatianBoats Rebooking Credit toward a future Booking Fee, in accordance with the traveller Terms.

Where a cancellation is avoidable — for example a scheduling error or a double booking — CroatianBoats may seek recovery from you for the credit issued or losses caused, recorded as an outstanding amount on your account. No card is charged automatically, and account standing and features such as Instant Book may be affected.

Cancellations for genuine safety reasons, including weather, mechanical problems, port or authority restrictions and emergencies, are reviewed differently and are not treated as avoidable. CroatianBoats does not penalise legitimate safety decisions.

You must select a cancellation reason so each cancellation can be reviewed fairly. Amounts and classifications may be reassessed, waived or adjusted by CroatianBoats where appropriate or where required by applicable law.

You keep ownership of your original content. CroatianBoats does not claim ownership of anything simply because it was uploaded.

By uploading or submitting photographs, videos, logos, descriptions and other listing content to CroatianBoats, you grant CroatianBoats a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, publish, distribute, resize, crop, format, adapt and use that content for the operation, promotion and marketing of CroatianBoats and of your listing.

This licence covers use on: CroatianBoats.com; CroatianBoats social media accounts; Instagram, Facebook, TikTok and YouTube; Search, display and digital advertising; Email marketing and CroatianBoats newsletters; Promotional videos and destination campaigns; Print advertising, brochures and trade shows; Tourism promotions, public relations and presentations; Other CroatianBoats-owned or authorised promotional channels.

The licence allows CroatianBoats to promote both your particular boat and the CroatianBoats marketplace, without asking for new permission for every individual post.

Private operator documents and personal information are never marketing content and are not covered by this licence.

Factual marketing claims about price, availability, Instant Book or verification must always come from current platform data.

Final licence scope and duration are subject to review by Croatian and EU counsel.

You confirm that you own, control or have permission to use the photographs, videos, logos, descriptions and other content you upload, and that you have the authority to grant the rights described above.

You must not upload content that knowingly infringes another person's copyright, trademark, privacy, publicity or other rights.

You confirm you have the appropriate rights and permissions for anyone who appears recognisably in the content you upload, where permission is legally required.

Please do not upload images of identifiable children for marketing use unless you have the authority and consent to do so.

For the easiest approval, upload clean photographs of the boat, the scenery and the experience, where you have permission to use everything visible.

Potentially sensitive imagery may be held for manual review before it is used in marketing.

CroatianBoats may display your business or trading name, boat name and business logo on the platform and in marketing relating to your listing.

Being listed or promoted does not imply partnership, endorsement, employment, joint venture or CroatianBoats ownership of your boat.

Our intermediary role; your responsibility for the rental service, licences, permits and insurance; accuracy of listing information; your authority to list the boat; rental payment, deposit, cancellation and refund responsibility; the weather disclaimer and the absence of any weather or safety guarantee; the Booking Fee disclosure and its refund policy; Instant Book and Request to Book obligations; contact-information circumvention; intellectual property and the content licence; photo and media permissions; reviews; prohibited content; fraud and misrepresentation; account suspension and removal; the complaint and dispute process; privacy and data processing; consumer rights; applicable taxes; platform availability and outages; third-party services and data; force majeure; limitation of liability and indemnity to the extent legally permitted; governing law and jurisdiction subject to mandatory consumer protections; and policy versioning with acceptance records.

Each acceptance you give during Review & publish is stored with its date, version and account.
