Refund policy
CroatianBoats collects only its Booking Fee. The boat rental payment and any security or rental deposit are collected by, held by and refunded by the independent boat operator under their own terms and applicable law.
Before the booking service is completed, the Booking Fee is handled according to the booking's current state and CroatianBoats' applicable policy.
Once the booking service is completed — the fee payment has succeeded, the booking is confirmed and contact information has been released — the CroatianBoats Booking Fee is generally non-refundable, except where required by applicable law or where CroatianBoats expressly provides otherwise under its Terms.
A traveller who cancels a confirmed booking does not automatically receive a Booking Fee refund. CroatianBoats also does not automatically refund rental payments, deposits or other amounts paid directly to an operator, because CroatianBoats never received or controlled those funds.
If an independent operator cancels a confirmed booking, CroatianBoats may provide the traveller with a CroatianBoats Rebooking Credit in accordance with its Terms, rather than a cash refund. A Rebooking Credit applies toward eligible future CroatianBoats Booking Fees, may be used partially with any eligible unused balance remaining available, and cannot be exchanged for cash except where required by applicable law.
Cancellations caused by weather, mechanical problems, port or government restrictions, safety issues, emergencies or other circumstances outside CroatianBoats' control do not create a promise of a refund. Any treatment of the Booking Fee or a Rebooking Credit in those situations follows these Terms and applicable law.
Disputes about the rental price, deposits, fuel, skipper charges, extras, damages or other amounts paid directly to the operator are primarily matters between the traveller and the operator, because CroatianBoats does not receive or hold those funds.
If a duplicate CroatianBoats Booking Fee payment is received for the same booking, the duplicate may be refunded without cancelling the legitimate confirmed booking, without affecting access to the operator's contact details and without changing the status of the legitimate Booking Fee.
A change in weather or forecast does not by itself create a right to a refund of the Booking Fee. This includes rain or wind in the forecast, a traveller deciding not to go because of weather, a change of plans, or a view that conditions are undesirable.
If an operator/skipper determines that a trip cannot proceed, the operator remains responsible for handling any rental money or deposit paid directly to them. The CroatianBoats Booking Fee is assessed separately under this policy.
Refund eligibility is determined only under this central policy by CroatianBoats. Automated systems and the CroatianBoats assistants (Marija and Luka) do not determine refund eligibility and cannot promise a refund.
CroatianBoats administrators retain the ability to issue a full or partial refund, issue credit where supported, or document an exception where permitted by CroatianBoats policy, payment rules or applicable law.
This language is subject to final review against applicable Croatian and EU law before production legal terms are finalised.
